AI Translator Terms of Service

Welcome to AI Translator! These Terms of Service ("Terms," "Agreement") govern your access to and use of the AI Translator: Voice & Photo mobile application ("App," "Service," "AI Translator") provided by AI Translator ("we," "us," "our"). By downloading, installing, accessing, or using AI Translator, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using AI Translator on iOS devices, you acknowledge that:

• You have read, understood, and agree to be bound by these Terms
• You have read and agree to our Privacy Policy, which is incorporated into these Terms by reference
• You are at least 13 years of age (or the minimum age in your jurisdiction)
• You have the legal capacity to enter into this binding agreement
• If using the App on behalf of an organization, you have authority to bind that organization to these Terms
• You will comply with all applicable laws and regulations while using the Service
• You consent to in-app advertising through Google AdMob and in-app purchases through Apple App Store as described in Section 5

These Terms apply to all users of the App, including free users and premium subscribers.

2. Description of Service

AI Translator is a mobile translation application that provides comprehensive language translation services across 320+ languages. The App offers the following features and services:

2.1 Core Translation Features

• Voice Translation: Real-time voice-to-voice translation with automatic language detection
• Text Translation: Instant text translation with context-aware AI processing
• Photo Translation: Camera and photo-based text recognition and translation
• Face-to-Face Mode: Conversational translation interface for natural two-way communication
• Side-by-Side Mode: Collaborative viewing for both conversation participants
• Translator Keyboard: System-wide keyboard for translating in any app
• Translation History: Local storage of past translations for quick access
• Offline Translation: Download language packs for translation without internet connection
• Phrasebook: Collection of essential travel phrases and common expressions

2.2 Free Version Features

• All core translation features with ads displayed
• Limited offline language pack downloads
• Standard AI translation quality
• Basic customer support
• Standard translation history storage

2.3 Premium Features (In-App Purchase/Subscription)

• Unlimited offline language pack downloads
• Advanced AI translation models for improved accuracy
• Ad-free experience (no Google AdMob advertisements)
• Priority customer support
• Extended translation history
• Document translation with file format preservation
• Custom phrasebook creation and management
• Audio playback speed control

2.4 Monetization Through Advertising and In-App Purchases

AI Translator is supported through two monetization methods:

• Advertising: The free version displays advertisements served by Google AdMob
• In-App Purchases: Premium features are available through optional in-app purchases and subscriptions processed by Apple App Store

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes to core features.

3. User Accounts and Registration

3.1 Account Creation

While many features are available without registration, certain premium features require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account
• Use only one account per person

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us at engr.salmankh.77@gmail.com of any unauthorized access or security breach. We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Termination

You may delete your account at any time through the App settings or by contacting us. Upon account deletion:

• Your account information will be permanently deleted within 30 days
• Active subscriptions will continue until the end of the billing period unless canceled in App Store settings
• Local data on your device (including translation history) will remain until you uninstall the App
• Downloaded language packs will remain on your device

4. User Responsibilities and Acceptable Use

4.1 Permitted Use

You may use AI Translator for personal, educational, or commercial purposes to facilitate communication and language translation. You agree to use the Service in compliance with all applicable laws and regulations.

4.2 Prohibited Activities

You agree NOT to:

• Use the App for any illegal, fraudulent, or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, circumvent, or disable any security features or protections
• Bypass or disable ad blocking mechanisms or attempt to prevent advertisement display
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the App's functionality or servers
• Upload malicious code, viruses, or harmful content
• Violate any applicable laws or third-party rights
• Attempt to gain unauthorized access to other users' accounts or data
• Use the App to translate or distribute illegal, harmful, or offensive content
• Sell, rent, lease, or redistribute the App without authorization
• Create derivative works based on the App
• Use the App in a manner that could damage our reputation or brand
• Bypass geographical or content restrictions
• Share your account credentials with others
• Attempt to commit ad fraud or manipulate in-app purchase systems
• Use VPNs or other tools to circumvent regional ad restrictions

4.3 Translation Content Responsibility

You are solely responsible for the content you translate using AI Translator. You represent and warrant that:

• You have the right to translate all content you input into the App
• Your use of translations does not violate any laws or third-party rights
• You will not use translations for harassment, discrimination, or hate speech
• You understand that AI translations may contain errors and should not be solely relied upon for critical communications

5. Subscriptions, In-App Purchases, and Payments

5.1 Premium Subscription and In-App Purchases

AI Translator offers premium subscriptions and in-app purchases to unlock additional features and remove advertisements. Available purchase options include:

• Weekly subscription (auto-renewing)
• Monthly subscription (auto-renewing)
• Annual subscription (auto-renewing, discounted rate)
• Lifetime premium access (one-time purchase)
• Individual premium features (as applicable)

5.2 Payment Processing and Billing

All in-app purchases and subscriptions are processed through Apple App Store. By making a purchase, you agree that:

• Payment will be charged to your Apple App Store account at confirmation of purchase
• For subscriptions, you will be charged for the selected period (weekly, monthly, or annual)
• Subscriptions automatically renew at the end of each billing period unless auto-renewal is disabled
• You will be notified before renewal with the amount to be charged
• Your account will be charged for renewal within 24 hours prior to the end of the current billing period
• You are responsible for all charges incurred from your Apple ID account
• You can manage subscriptions and disable auto-renewal in your device's App Store settings (Settings → [Your Name] → Subscriptions)
• Prices are in USD or your local currency equivalent and are subject to change with advance notice provided before renewal
• All prices include applicable taxes where required
• Apple, not AI Translator, processes all payment transactions and has access to your payment information

5.3 Free Trials

We may offer free trial periods for premium features. Terms for free trials include:

• Free trials are available only to users who have not previously purchased premium features
• Free trials are limited to one trial period per user, unless otherwise specified
• At the end of the trial period, your account will be automatically charged the full subscription fee unless you cancel before the trial ends
• To cancel a free trial and prevent charges, you must disable auto-renewal in your App Store settings at least 24 hours before the trial period ends
• We may modify or terminate trial offers at any time with reasonable notice
• Trial eligibility is determined at our discretion and is subject to Apple's policies

5.4 Refund Policy

All purchases and subscriptions are processed through Apple App Store and are governed by Apple's refund policies:

• Provide the reason for your refund request
• Submit the request to Apple for review

Apple's Refund Window: Apple generally grants refunds for in-app purchases made within 14 days if you request them within 14 days of purchase.

Direct Contact: In exceptional circumstances, you may contact us at engr.salmankh.77@gmail.com with details of your purchase, and we may assist by facilitating a request with Apple. However, the final decision on refunds rests exclusively with Apple, and we cannot guarantee refund approval.

Note: We do not process refunds directly. All refund requests must be directed to Apple through their official channels.

5.5 Subscription Management and Cancellation

You may manage, modify, or cancel your subscription at any time:

To Cancel or Modify Your Subscription:

• Go to iOS Settings → [Your Name] → Subscriptions
• Select "AI Translator" from your active subscriptions
• Tap "Cancel Subscription" to cancel auto-renewal
• Alternatively, access subscriptions through App Store → Account → Subscriptions
• You can also manage subscriptions directly in the AI Translator app through Settings → Subscription

Effects of Cancellation:

• Premium access will continue until the end of your current billing period
• No refund will be provided for the remaining portion of the current billing period
• After the current period ends, your account will revert to the free version
• Premium features will no longer be available
• You will begin seeing advertisements from Google AdMob
• Downloaded offline language packs will remain accessible
• Your translation history will remain on your device

5.6 Price Changes

We reserve the right to change subscription pricing with reasonable advance notice. You will be notified of price changes before your next renewal date. If you do not agree to new pricing, you may cancel your subscription before the price change takes effect.

5.7 Payment Problems

If your payment method fails or is declined:

• Apple will attempt to charge your account again at a later date
• Your subscription may be suspended until a valid payment method is provided
• Repeated payment failures may result in account deactivation
• Contact Apple Support if you need to update your payment method

6. Advertising (Google AdMob)

6.1 In-App Advertising

AI Translator displays advertisements in the free version through Google AdMob. By using the App, you agree to:

• View and interact with advertisements served by Google AdMob
• Allow Google and third-party advertisers to serve ads within the App
• Comply with advertiser terms and clicking on ads only when genuinely interested
• Not interfere with ad display or attempt to block advertisements

6.2 Ad Frequency and Placement

We aim to balance user experience with monetization. Advertisements appear:

• Between translations (interstitial ads)
• At the bottom of the screen (banner ads)
• Before accessing certain features (video ads)

Ad frequency may vary based on your usage patterns and device specifications.

6.3 Premium Ad-Free Experience

By purchasing a premium subscription, you can remove all advertisements. Premium users will not see:

• Google AdMob banner ads
• Interstitial advertisements
• Video advertisements
• Any third-party promotional content

6.4 Google AdMob Policies and Data Collection

Advertisements are served by Google AdMob in accordance with:

• Google's Privacy Policy
• Google AdMob Terms of Service
• Google's Ad Technology Policies

Google collects and uses data for ad personalization as described in their privacy policies. Your interaction with ads is governed by Google's terms, and we encourage you to review their policies.

6.5 User Control Over Ads

You have the following options to control ad personalization:

• Disable Personalized Ads: Go to iOS Settings → Privacy → Apple Advertising → turn off "Personalized Ads"
• Reset Advertising ID: Go to iOS Settings → Privacy → Apple Advertising → Reset Advertising ID
• Limit Ad Tracking: Go to iOS Settings → Privacy → Tracking → disable app tracking
• Google Ad Settings: Visit https://adssettings.google.com to manage your Google ad preferences
• Purchase Premium: Subscribe to remove all ads completely

Even if you disable personalized ads, you will still see advertisements, but they may be less relevant to your interests.

6.6 No Responsibility for Third-Party Ads

We are not responsible for:

• The content, accuracy, or quality of advertisements
• The behavior or policies of advertisers or third-party ad networks
• Transactions or interactions you have with advertisers
• Links to third-party websites or content accessed through ads
• Any claims or disputes arising from advertisements

If you click on an ad and interact with a third-party advertiser, your interactions are governed by that advertiser's terms and privacy policies, not ours.

6.7 Prohibited Ad Behavior

You agree not to:

• Click on advertisements with no genuine interest in the advertised product or service
• Use ad fraud techniques or automated tools to artificially inflate ad impressions or clicks
• Manipulate ad performance metrics or engage in click fraud
• Use VPNs to circumvent regional ad restrictions or manipulate ad serving
• Interfere with the technical delivery of advertisements

Violation of ad policies may result in account suspension or termination.

7. Intellectual Property Rights

7.1 Our Intellectual Property

AI Translator, including all content, features, functionality, source code, algorithms, AI models, user interface, graphics, logos, and trademarks, is owned by us and protected by international copyright, trademark, patent, and other intellectual property laws. You acknowledge that:

• The App is licensed to you, not sold
• We retain all rights, title, and interest in the App
• You do not acquire any ownership rights through use of the App
• All trademarks, service marks, and logos are our property or the property of our licensors
• The AI translation models and algorithms are proprietary trade secrets

7.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal iOS devices
• Use the App for personal, educational, or commercial purposes as described in these Terms
• Access and use features in accordance with these Terms and applicable laws

This license automatically terminates if you violate these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

7.3 Your Content and Translations

You retain ownership of all content you input into AI Translator and the translations generated. By using the App, you grant us a limited license to:

• Process your input content to generate translations
• Store translation history locally on your device
• Use aggregated, anonymized translation data to improve our AI models (with your consent)

We do not claim ownership of your content or translations. We will not use your specific translations for any purpose other than providing the Service to you.

7.4 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into our products and services without compensation or attribution to you.

8. Translation Accuracy and Limitations

8.1 AI Translation Limitations

You acknowledge and understand that:

• AI Translator uses artificial intelligence and machine learning for translations
• Translations may contain errors, inaccuracies, or cultural misunderstandings
• Context, idioms, slang, and technical terms may not translate accurately
• Different languages have varying levels of translation quality based on available training data
• Offline translations may be less accurate than online translations
• Voice recognition accuracy depends on audio quality, accents, and background noise
• Photo text recognition depends on image quality, lighting, fonts, and text clarity

8.2 No Professional Translation

AI Translator is NOT a substitute for professional human translation services. You should NOT rely on AI Translator for:

• Legal documents, contracts, or agreements
• Medical diagnoses, prescriptions, or healthcare communications
• Financial transactions or binding commitments
• Official government documents or immigration forms
• Academic papers or certified translations
• Safety-critical communications

For important documents and communications, always consult a certified professional translator.

8.3 Your Responsibility to Verify

You are responsible for verifying the accuracy of translations before using them for any purpose. We recommend:

• Cross-checking important translations with multiple sources
• Having critical translations reviewed by a native speaker
• Using context and common sense to identify potential errors
• Understanding cultural differences that may affect translation meaning

9. Third-Party Services and Content

9.1 Third-Party Translation APIs

AI Translator may use third-party translation APIs and services to provide online translation functionality. These services are subject to their own terms and privacy policies. We are not responsible for the performance, availability, or policies of third-party services.

9.2 Third-Party Links and Advertising

The App may contain links to third-party websites, apps, or content. Advertisements may also link to third-party sites. We do not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is at your own risk and governed by their respective terms and privacy policies.

9.3 Language Packs

Offline language packs are provided for your convenience. We do not guarantee:

• Availability of all language pairs for offline use
• Equal quality across all offline language packs
• Continued availability of any specific language pack
• Compatibility with all device models and iOS versions

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using AI Translator, you consent to our Privacy Policy.

Key privacy points:

• Translations are processed locally on your device when using offline mode
• Online translations are sent to servers via encrypted connections and not permanently stored
• Translation history is saved locally on your device only
• We do not sell your personal information or translation data
• You can delete your translation history at any time
• Google AdMob collects advertising data for ad personalization (see Privacy Policy Section 5)
• In-app purchase information is handled exclusively by Apple

11. Disclaimers and Warranties

11.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be error-free, uninterrupted, or secure
• Warranties regarding the accuracy, reliability, or completeness of translations
• Warranties that defects will be corrected or that the App will meet your requirements
• Warranties that translations will be culturally appropriate or contextually accurate
• Warranties that advertisements will not be intrusive or objectionable
• Warranties regarding the performance of in-app purchases or subscriptions

11.2 Translation Quality Disclaimer

We do not guarantee that AI Translator will:

• Provide accurate translations for all content and languages
• Correctly translate idioms, slang, technical terms, or cultural references
• Understand context, tone, or nuanced meanings
• Work effectively with all accents, dialects, or speech patterns
• Recognize text in all fonts, handwriting styles, or image conditions
• Be suitable for professional, legal, or medical purposes

11.3 Service Availability

We do not guarantee that:

• The App will be available at all times or in all locations
• Online translation features will work without internet connectivity
• The App will be compatible with all devices or iOS versions
• Features will not be modified, suspended, or discontinued
• Advertising services will always be available or functional
• In-app purchases will be processed without delays or issues

12. Limitation of Liability

12.1 Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AI TRANSLATOR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

• Indirect, incidental, consequential, punitive, or special damages
• Lost profits, revenue, data, business opportunities, or goodwill
• Translation errors, inaccuracies, or misunderstandings
• Damages arising from reliance on translations for important decisions
• Communication failures or misunderstandings resulting from translations
• Device damage, data loss, or system malfunction
• Third-party claims arising from your use of translations
• Any damages arising from use or inability to use the App
• Issues with Google AdMob advertisements or third-party advertisers
• Problems with in-app purchases, subscriptions, or billing
• Loss of advertising revenue or subscription payments

12.2 Maximum Liability

Our total liability to you for any claims arising from your use of AI Translator shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

12.3 Essential Purpose

Some jurisdictions do not allow limitation of liability for certain damages. If your jurisdiction does not allow such limitations, the above limitations may not apply to you, but our liability shall be limited to the fullest extent permitted by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless AI Translator, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations
• Content you translate or actions you take based on translations
• Your negligent or willful misconduct
• Disputes with other users arising from translations or communications
• Your interaction with advertisements or advertisers
• Your use of in-app purchase features

14. Modifications to Terms and Service

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Notify you through the App or via email for material changes
• Provide reasonable time to review changes before they take effect

Your continued use of AI Translator after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and may request account deletion.

14.2 Changes to Service

We may modify, suspend, or discontinue any feature of the Service at any time, with or without notice. This includes:

• Adding or removing languages
• Modifying translation algorithms or AI models
• Changing subscription pricing or features
• Discontinuing offline support for certain languages
• Adding or removing third-party integrations
• Modifying advertising frequency or format
• Changing in-app purchase options or pricing

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Termination

15.1 Termination by You

You may terminate these Terms at any time by:

• Uninstalling the App from your device
• Deleting your account through App settings
• Ceasing all use of the Service

15.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice or liability, if you:

• Violate these Terms or our policies
• Engage in fraudulent, illegal, or abusive activities

• Violate the rights of other users or third parties
• Fail to pay subscription fees (for premium users)
• Attempt to circumvent technical limitations or security measures
• Engage in ad fraud or manipulate in-app purchase systems

15.3 Effects of Termination

Upon termination of your account:

• Your right to use the App immediately ceases
• Your account data will be deleted according to our retention policies
• You will lose access to premium features (if applicable)
• No refunds will be provided for unused subscription periods
• Local data on your device will remain until you uninstall the App
• Provisions intended to survive termination shall remain in effect

16. Dispute Resolution

16.1 Informal Dispute Resolution

Before filing any legal claim, you agree to contact us at engr.salmankh.77@gmail.com to attempt to resolve the dispute informally. Provide a detailed description of the dispute and your desired resolution. We will attempt to resolve the dispute within 60 days of receiving your notice.

16.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where AI Translator operates, without regard to its conflict of law provisions.

16.3 Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of a recognized arbitration association. The arbitration shall be conducted in English (with translation provided if necessary) and will take place in a neutral location or online as agreed by the parties.

16.4 Class Action Waiver

YOU AND AI TRANSLATOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Translator regarding use of the App and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

17.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms or our rights under these Terms without your consent in connection with a merger, acquisition, or sale of assets.

17.5 Language

These Terms are written in English. Any translations provided are for convenience only. In case of conflict between the English version and a translated version, the English version shall prevail.

17.6 Apple App Store Terms

If you download AI Translator from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and AI Translator, not Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for the App or its content
• Apple is not responsible for addressing any claims related to the App, in-app purchases, or subscriptions
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with all applicable third-party terms when using the App
• Apple's App Store Terms of Service apply to your use and download of the App
• In-app purchases and subscriptions are processed by Apple and governed by Apple's terms

17.7 Google AdMob Terms

By using AI Translator with advertisements displayed, you agree to:

• Comply with Google AdMob's terms of service and policies
• Allow Google to serve advertisements within the App
• Allow Google to collect data for ad personalization as described in their privacy policies
• Acknowledge that Google is a third-party beneficiary of these Terms
